工程质量责任体系研究

摘 要

随着我国经济的发展，我国在工程建设方面取得的成就令世界瞩目，然而，近些年来因为工程质量不合格而导致的路面塌方，桥梁毁坏，房屋倒塌的工程质量问题频频发生，对我国人民群众的人身财产安全造成了极大的威胁。可是当工程发生质量事故后，往往无法明确具体责任人，从而导致没法追究责任人的责任，质量责任难以落实。这说明我国用于发生事故后追就责任的工程质量责任体系尚未完善，所以工程出了事故后各方相互推诿责任，责任追究难以落实。我国工程建设方面起步较晚，工程质量责任体系的建设相对落后，它适用于一些通用工程建设模式，但时代在发展，新兴市场经济模式下，工程建设模式早已不再只有传统的政府主导和民企主导的建设模式，还涌现出了许多新兴工程建设模式，这些新兴工程建设模式对我国旧有的工程质量责任体系提出了新的要求。

本文研究主要分为四个部分：首先总结分析了政府主导工程这类通用建设模式下的责任体系框架，分析当前工程质量责任体系存在的问题，然后简单介绍了当前市场经济下涌现出的几种新兴工程建设模式的概念和运作方式，接下来分析这些新型工程建设模式对我国已经建立的工程质量责任体系的影响，最后通过借鉴国外的先进经验，对我国的工程质量责任体系提出建设性的意见。

Abstract

Along with the development of our economy, our country's achievements in the engineering construction has drawn attention of the world. However, in recent years because of the engineering quality is unqualified and cause of road surface collapse, Bridges destroyed houses collapsed in the engineering quality problem occurred frequently, the safety of the personal property of the people in China caused great threat. But when a quality accident occurs, it is often impossible to specify the specific person responsible, thus causing the responsibility of the person to be held accountable, and the quality responsibility is difficult to implement. This shows that China's engineering quality responsibility system is not perfect after the accident, so it is difficult to carry out the responsibility after the accident. Engineering construction has started late in our country, the construction of the engineering quality responsibility system is relatively backward, it is suitable for some common construction mode, but in social development, and the emerging market economy mode, the project construction mode no longer only traditional government-led and corporation for the construction of the dominant mode, also emerged many new construction mode, these emerging engineering construction mode of our country old has proposed new requirements on engineering quality responsibility system.

In this paper, we study mainly divides into four parts: first, the government leading engineering were analyzed and summarized in this paper and the corporation leading engineering responsibility system framework of this kind of general construction mode, then introduces the current emerged under the market economy concepts and patterns of several emerging engineering construction works. Then analysis these new engineering construction pattern of our country has set up the engineering quality responsibility system, the influence of finally, draw lessons from foreign advanced experience, combined with their own thinking, to our country's engineering quality responsibility system put forward constructive Suggestions.
