社区矫正处遇模式的比较研究

摘 要

所谓社区矫正，就是将符合一定条件的犯罪人放置于社区中，由专门机构以及社会力量对其进行教育、监管和帮助，从而减少犯罪率并促使犯罪人重返社会的刑罚执行制度。它在西方法治先进国家已是主要的刑罚执行方式，规避了监禁刑的许多弊端，但在我国仍处于试点阶段，尚未建立完善的社区矫正制度，因此需要讨论切合我国国情的适用。

文章共分为四部分。

文章第一部分从解析社区矫正的基本概念入手，对比学术界和实务界具有代表性的观点，并提出了笔者自己的观点。还总结了社区矫正制度的利弊，利能成为支撑该制度发展的依据，而认识弊有利于我国在设计相关制度的时候将其弊端降到最低。

文章第二部分阐述了社区矫正的先进处遇模式及特点，主要介绍英美德日的社区矫正处遇模式，并总结其立法特点及优点。

文章第三部分总结了我国社区矫正的立法现状，以及以江苏省为代表介绍了我国社区矫正的实践现状。并从法律和实践层面指出我国社区矫正制度存在的不足。

文章第四部分分别从观念层面、法律层面、实践层面对我国社区矫正制度的发展提出了的改进建议，希望我国社区矫正工作能切实有效地开展起来。

A comparative study of Community Correction Treatment Mode
Abstract

Community correction is an ease and economy form of the execution of punishment which is placing the eligible offenders in the community, let them educated, assisted and supervised by the specialized agencies and social forces to the education, in order to reduce the rate of crime and help the offenders return to society smoothly . Community correction is a major penalty implementation in Western developed countries, it avoid many drawbacks of custodial penalty, but is still in the pilot stage in China, so it is need to discuss the application in Chinese case.

The article is divided into four parts.

The first part of the article start from realizing the basic concepts to community correction. By comparing to academia and practice representative opinions, I put forward my own view. The article also introduces the advantages and disadvantages of community correction system. The advantages are the basis of community correction system and realizing the disadvantages can help China minimize its disadvantages.

The second part of the article describes the modes and features of advanced community correction treatment modes, mainly in the United States, Britain, Germany, Japan, also summarizes the characteristics and advantages of them.

The third part of the article summarizes Chinese current situation of legislation about community correction. Represented by Jiangsu province, this part also introduces the current situation of the practice of community correction in China. Point out the drawbacks of community correction system in China in the aspects of law and practice.

The fourth part presents recommendations in the aspects of awareness, law and practice for improving our community correction system, hoping that community correction work can be efficiently and effectively carried out in China.

前 言

“社区矫正”是我国从西方国家引入的一个概念。作为一种不同于监禁矫正的矫正措施，无论是学术界对其的定义还是各国在实践中的具体做法都存在着差异。但大体上来说社区矫正是对那些再犯可能性小的犯罪人，不再一律进行关押或继续关押，而只是在一定程度上限制其人身自由，同时对其进行必要的辅导和帮助，达到使犯罪人顺利“回归社会”以及“再社会化”的目的。

几十年来，社区矫正因其体现了先进的刑罚理念，符合实现人道主义的世界潮流而成为绝大多数国家在刑罚领域的朝阳制度和明智选择。随着实践的发展，社区矫正在弥补犯罪行为造成的伤害、帮助犯罪人重新成为文明一员以及修复受损的社会关系等方面都表现出了积极的作用。相较一些国家已经形成的相当完善的社区矫正制度，我国的社区矫正制度仍然处于试行阶段，其理念还没有被广大民众所了解，在立法和实践上虽然有所发展但仍然存在许多不足。本文试从比较法视角出发，对其他国家和地区有关社区矫正的立法和实践经验进行研究，并与我国社区矫正的现状相比较，来论证我国在社区矫正的立法和实践方面存在的不足，并对完善我国社区矫正处遇模式提供探索性的建议。
