全过程咨询合同使用调查与设计建议

摘 要

全过程工程咨询是我国建筑行业中的一次重要转型，但实践中由于缺乏相关政策引导支持，缺少相关合同指导文件，咨询单位相关经验不足、综合能力不够等原因，导致企业转型升级缓慢，开展全过程工程咨询导向不明，全过程工程咨询的发展受阻。因此，为推动全过程工程咨询发展，对全过程工程咨询合同的使用现状进行调查并对其设计提出建议具有重要现实意义。

本文将通过对当前国内已有的6份地区全过程工程咨询合同示范文本进行研究，分析所有合同的各项内容，确定全过程工程咨询合同文本的基本框架，为其他省份后期出台相关示范文本提供参考，进而推动全过程工程咨询在全国范围内的推广，鼓励更多有能力的咨询单位整合资源和能力，积极开展全过程工程咨询服务。

然后，本文通过研究江苏省目前已经开展的部分全过程工程咨询项目，对其进行案例分析，应用csQCA的分析方法，确定全过程工程咨询服务发包内容与合同中约定的组织模式和取费模式之间的关系。并以此为全国范围内的其他全过程工程咨询项目合同设计起草提供建议。

最后，运用已有全过程工程咨询案例，对其进行组织模式及取费模式的分析，验证以上所得结论。本文的研究对全过程工程咨询合同的实际设计提出一系列的建议，为其他全过程工程咨询项目提供了参考。

Abstract

Whole-process engineering consultation is an important transformation in China's construction industry, but in practice, due to the lack of policy support and guidance, the lack of relevant contract guidance documents, insufficient experience and comprehensive ability of consultants, the transformation and upgrading of enterprises is very slow, how to carry out the whole process of engineering consulting is unclear, the development of engineering consulting in the whole process is blocked. Therefore, in order to promote the comprehensive development of the whole process consultation in China, it is necessary to investigate the status of application of the whole-process engineering consulting contract and make some suggestions for the design of the contract.

This paper will study the demonstration texts of the six regional whole-process engineering consulting contracts currently in China, analyze the contents of all contracts, determine the basic framework of the whole-process engineering consulting contract text, and provide relevant model texts for other provinces. References, in order to achieve the promotion of the whole process consultation nationwide, encourage more competent consulting units to integrate resources and capabilities, and actively carry out the whole-process engineering consulting services.

Then, this paper studies the part of the whole-process engineering consulting project that has been carried out in Jiangsu Province, analyzes the cases, and applies the csQCA to determine the relationship of the content of the whole-process engineering consulting service and the mode including the organization mode and the fee collection mode agreed in the contract. By this way, we can provide advice for the successful designing and writing of other full-process consulting projects across the country.

Finally, according to the whole-process engineering consulting cases, the analysis of the organization mode and the fee collection mode is carried out to verify the conclusions drawn above. This paper puts forward a series of suggestions on the actual design of the whole-process engineering consulting contract, which provides a reference for other types of projects in the future.
