征地安置补偿纠纷法律解决机制研究

摘 要

随着我国城市化和工业化的发展，征收行为日益增多。同时也出现了大量与征地有关的纠纷。其中，征地安置补偿纠纷便是征地纠纷中的重要组成部分。征收安置补偿纠纷作为当下我国主要的行政纠纷，特别是法院行政诉讼受案占比较高，同时因为该类案件的法律较原则、法律行为多样、过程多样。仅通过法院的行政诉讼途径来解决征地安置补偿纠纷存在力不从心的现象。因此，有必要从多元纠纷解决机制角度来研究征地安置补偿的争议问题。

本文共分为六个部分。第一部分是引言，对本课题的研究背景、意义、内容以及方法进行简单的叙述。第二部分是对于征地安置补偿纠纷法律解决机制的概述。第三部分则重点分析了当前我国征地安置补偿纠纷法律解决机制的主要类型，分别论述了各纠纷解决类型的实施情况，并分析了各类型存在的不足及其症结所在。第四部分是对英国、美国等域外国家相关机制的经验进行分析并寻找其中可资借鉴之处。第五部分则是依据之前的分析和总结提出对于我国征地安置补偿纠纷法律解决机制的改进建议。最后一部分是结语，对之前的论述进行总结评述。

ABSTRACT

With the development of urbanization and industrialization in China, expropriation behavior is increasing. At the same time, there are a lot of disputes related to land acquisition. Among them, land resettlement compensation dispute is an important part of land disputes. Expropriation, settlement and compensation disputes are the main administrative disputes in China at present, especially administrative litigation cases of the court account for a relatively high proportion. At the same time, the legal principles, legal acts and process of such cases are diverse. Only through the court's administrative litigation way to solve the land resettlement compensation disputes there are inadequate. Therefore, it is necessary to study the dispute of land resettlement compensation from the perspective of multiple dispute settlement mechanism.

This paper is divided into six parts. The first part is the introduction, which briefly describes the research background, significance, content and method of this subject. The second part is an overview of the legal settlement mechanism of land requisition compensation dispute. The third part mainly analyzes the main types of legal settlement mechanism of land requisition compensation disputes in China, discusses the implementation of various types of dispute settlement, and analyzes the shortcomings of each type and its crux. The fourth part is to analyze the experience of the relevant mechanisms of the UK, the United States and other countries outside the region and to find out what can be used for reference. The fifth part is based on the analysis and summary of the previous suggestions for the improvement of the legal settlement mechanism of land requisition compensation disputes in China. The last part is the conclusion, which summarizes the previous discussion.

这些年来，伴随着我国经济水平的稳步提高以及国民经济结构的转型和调整，我国的工业化和城市化也进入了快速发展的时期。随之而来的便是城市建设用地需求的大规模增长。但同时因为我国土地资源的稀有性，面对土地需求的迅速增长，通过土地征收这一独特的增加可使用的城镇建设用地以缓解供给紧张的土地需求已成为当前保障和维持城市化进程和经济发展的重要手段。
