摘 要

上古伏羲女娲图中，二神一规一矩，是中国先人最朴素的标准化意识萌芽。随着科技的发展，标准逐渐成为衡量一个国家产业发展水平的标志，而且随着智能网联汽车不断应用到我们的生产生活中，如何加快构建自动驾驶汽车及其关键系统部件功能安全、信息安全的智能网联汽车标准体系，如何在实践中逐步形成统一、协调的国家车联网产业标准体系架构，成为了当前自动驾驶汽车快速发展亟待解决的问题。

全文主体研究内容分为四个部分：第一部分总结自动驾驶汽车产品特点进而指出我国现行汽车产品标准应对汽车自动化发展的不足；第二部分研究自动驾驶汽车产品安全标准建设的需求与功能；第三部分通过借鉴域外法对于自动驾驶汽车建设标准的有关规定，提出可资借鉴的经验；第四部分对完善自动驾驶汽车标准的制定和实施提出完善建议。论文研究成果对于完善我国自动驾驶汽车产品安全标准规制体系，推动我国自动驾驶汽车产业快速发展具有重要的理论意义与实践价值。

Abstract

Standard is not only a strong technical work, but also a public affairs management work related to the national economy and people's livelihood. It is also a very important basis for judging the rights and obligations of litigants. Setting standards should be based on the legal, technical and administrative attributes of setting standards; their manifestations include not only various legislative and other abstract administrative acts, but also various forms of civil and commercial subjects' self-discipline and negotiation behavior; with the development of science and technology, standards have gradually become the symbol of measuring a country's industrial development level, and with the development of intelligent network automobile. How to speed up the construction of the intelligent network standard system of automatic driving vehicle and its key components, functional safety and information security, and how to gradually form a unified and coordinated national vehicle network standard system structure in practice has become an urgent problem to be solved in the rapid development of the current automatic driving vehicle.

This article is divided into four parts to study the safety standards of the automatic driving vehicle: the first part summarizes the characteristics of the product of the autopilot car, and then points out the deficiency of the current automobile product standard to the development of the automobile automation. The second part studies the demand and function of the product safety standard construction of the autopilot vehicle, and the third part is about the construction of the autopilot vehicle by referring to the extraterritorial law. In the fourth part, we put forward some suggestions for improving the standards of the automatic driving vehicle. The research results in this paper have important theoretical and practical values for improving China's automated vehicle product safety standard regulation system and promoting the rapid development of China's automated vehicle industry.

一、绪论

（一）研究背景

自动驾驶汽车产品的安全标准用于设计和制造无人驾驶自动汽车，对无人驾驶自动汽车的安全和发展提供重要保障。随着科学技术不断推进社会经济文化水平的不断发展，自动驾驶汽车技术随着科技和经济的推进呈跨越式的发展。汽车产品的制造和生产工业逐渐成为各国经济的主要支柱产业，其标准的发展和也日新月异，自动驾驶汽车的研究领域正在迅速发展^[[1]]。自动驾驶汽车在现实生活中的应用不仅限于现场测试阶段，而更多的发展到了实车道路测试阶段。基于自动驾驶汽车领域在实际应用方面对技术性的要求很高，自动驾驶汽车标准的完善对促进相关领域的发展会起到很大的作用，完善自动驾驶汽车领域的标准订立显得极其重要。目前，欧洲和美国等国家通过修订相关法律和标准，对这类人工智能车辆的管理提出了明确要求。中国的汽车制造商也启动了自动驾驶汽车的研究计划，并积极推动自动驾驶汽车计划的实施。但总体而言，自动驾驶汽车这个新兴产品对于当前的科技水平来说，仍然处于测试和不断完善的阶段，虽然在实际应用中自动驾驶汽车这类新兴产品存在很多缺陷和不足，但笔者认为，随着科学技术的不断发展，人工智能技术将为我们的生活带来极大的便利。越来越多的自动化汽车将进入我们的生活，自动驾驶汽车技术的发展是不可避免的。它将对中国的传统汽车制造业，智能交通和互联网公司产生重大而深远的影响。同时，对于道路交通管理，自动驾驶汽车的应用也将对现有的道路交通管理提出新的要求和挑战。因此，分析我国汽车标准的现状，研究现行汽车产品标准应对汽车自动化发展的不足，找到相应的解决方案，是我国自动驾驶汽车产业快速发展的前提和保障。

（二）国内外研究综述

1. 自动驾驶汽车产品界定与分类

自动驾驶的概念最初是在20世纪提出的，并在在21世纪初发展为接近实用性功能。自动驾驶汽车是指在传统的机动车上配备先进的自动驾驶系统以及车载传感器等硬件设施设备。它集成了现代通信技术和网络技术，实现了车辆与周围环境中的人事物，以及数据处理中心之间的具有人工智能的电子信息交换 。自动驾驶汽车在道路运行过程中，能够依靠车载信息系统，识别车辆周围环境，通过信息系统返回的数据作出决策并执行，为驾驶人或乘坐人提供了一个高效、舒适、安全的行车模式。并最终可实现替代人来操作的新一代汽车。根据其自动驾驶级别，这种类型的车辆通常具有六个等级。2014年美国公路安全管理局（NHTSA）和美国汽车工程师协会（SAE）J3016标准是在提出的自动驾驶汽车智能等级分类的基础上发布的。通常情况下自动汽车驾驶汽车被分为(L0-L5)六个不同等级，不同等级对应的不同的汽车标准规范。

Level 0：汽车上没有配备自动装置，即驾驶员需要完全控制车辆。
