摘 要

本文主旨是探讨中国古代监察法的相关问题。全文以中国古代监察法的发展历程、基本特征、社会治理功效、得失分析以及现代借鉴为基本框架，探讨中国古代监察法制的丰富法文化内涵。中国古代监察法制发展历史悠久，源远流长。自先秦时期开始产生，历经秦汉、魏晋南北朝、唐宋，直至明清长达数二千余年之久，其产生和发展扎根于中国传统社会特有的土壤中，具有深厚的社会经济、政治及思想根源。中国古代监察法制数千余年陈陈相因，逐步形成体系完备、内容充实、规模宏大的传统监察法制文化，并在监察机构设置、监察官员选任、监察职责行使以及监察体制运行等诸多方面均独具特色。传统监察法制体系的建设与完备对社会治理发挥了积极功效。在我国当前大力推进监察法制建设、积极反腐倡廉的新形势下，结合中国古代监察法制的利弊得失，以古鉴今，为新时代我国监察法制建设提供现代借鉴。

ABSTRACT

The main purpose of this paper is to discuss the related problems of supervision law in ancient China. Based on the development course, basic characteristics, social governance effect, gain and loss analysis and modern reference of the supervision law in ancient China, this paper discusses the rich legal and cultural connotation of the supervision legal system in ancient China. In ancient China, the supervisory legal system has a long history and a long history. Since the Warring States Period period, after Qin and Han dynasties, Wei, Jin, Southern and Northern dynasties, Tang and Song dynasties, until the Ming and Qing dynasties for more than 2,000 years, its emergence and development are rooted in the unique soil of Chinese traditional society, with profound social economy. Political and ideological roots. In ancient China, the supervisory legal system lasted for more than thousands of years. The traditional supervision legal system culture with complete system, full content and large scale is formed, and it has its own characteristics in many aspects, such as the establishment of supervision institutions, the selection and appointment of supervisory officials, the exercise of supervision duties and the operation of supervision system. The construction and perfection of the traditional supervision legal system has played a positive role in social governance. Under the new situation of vigorously promoting the construction of supervision legal system and actively fighting corruption and promoting honesty in our country, combined with the characteristics, advantages and disadvantages of the development of supervision legal system in ancient China, this paper provides a modern reference for the construction of supervision legal system in China in the new era.

引言

中国古代监察法源远流长并独具特色。在新时期，反腐形势得到了深入发展，新设国家监察委员会作为最高国家监察机关并赋予了其宪法地位，体现了党在反腐工作中统一领导和加强对公职人员的监督的紧迫性。为了更好的发挥国家监察委员会的职能，需从中国传统监察体制中予以反思、汲取和转化，从而形成具有本土特色、符合时代要求的监察理论和实践。本文旨在挖掘中国古代监察制度流变过程中所体现的哲学意蕴、揭示其制度流变与社会两者存在的互动关系及规律、分析中国古代监察制度独具特色的法文化内涵及其提出新时代转化路径。
