全国人大常委会备案审查制度实证研究

摘 要

本文主要探讨的是全国人大的备案审查制度的实证研究，党的十九大提出要加强和落实合宪性审查制度。而合宪性审查制度在我国的制度落实还是需要着落在全国人大常委会这一主体上。从现行法律规定来看，我国宪法将宪法解释和宪法监督的权力赋予给了全国人大常委会，这就为它落实合宪性审查制度提供了最根本的法律保障；另一方面，我国立法法还规定了备案审查制度，这一制度虽然从根本来说与合宪性审查仍然有着本质的差距，但是全国人大常委会备案审查制度的有效展开一方面能够为合宪性审查的推行提供良好的法律环境，另一方面也能过为合宪性审查制度的落实在一定程度上提供制度资源。在时机成熟后，备案审查制度也可以由合法性审查逐渐扩大到合宪性审查。事实上，全国人大法工委法规备案审查室主任梁鹰就提出过这样的设想。因此，对全国人大常委会备案审查制度予以充分的研究对于我国合宪性审查的推动具有积极的意义。同时，尽管本研究重在对全国人大常委会备案审查制度进行实证研究，但是对根本的概念予以厘定也是本研究展开的基础，从这一方面看来，本研究也具有重要的理论意义。

Abstract

This paper is mainly about the "Record review system" of the Standing Committee of the National People's Congress. The Party's Nineteenth Congress proposed to strengthen and implement the Constitutional review system. In China, the implementation of the Constitutional review system needs to rely on the Standing Committee of the National People's Congress. Judging from the relevant provisions of existing domestic laws, the domestic constitution has given the NPC Standing Committee the power to “interpret the constitution and supervise the constitution”. This provides the most fundamental legal guarantee for the implementation of the Constitutional review system by the Standing Committee of the National People's Congress. On the other hand, Law on Legislation in China also stipulates the "Record review system." Fundamentally speaking, although the "Record review system" and the Constitutional review system still have a substantial gap, the implementation of the "Record review system" of the Standing Committee of the National People's Congress can provide a good legal environment for the implementation of the Constitutional review system. On the other hand, it can also provide necessary "institutional resources" for the implementation of the Constitutional review system. When the time is appropriate, “Record review system” can be gradually transformed and expanded by the Legality review system to become the Constitutional review system. In fact, Liang Ying, the director (from the Law Committee of National People's Congress’s Record review office) made such suggestions. Therefore, the research on the "Record review system" of the Standing Committee of the National People's Congress is of great significance to the promotion of the National Constitutional review system. This paper defines some related fundamental concepts. On this basis, this paper empirically studies the "Record review system" of the Standing Committee of the National People's Congress. Therefore, the study of this paper also has important theoretical significance.

党的十九大提出要加强和落实合宪性审查制度。而合宪性审查制度在我国的制度落实还是需要着落在全国人大常委会这一主体上。从现行法律规定来看，我国宪法将宪法解释和宪法监督的权力赋予给了全国人大常委会，这就为它落实合宪性审查制度提供了最根本的法律保障；另一方面，我国立法法还规定了备案审查制度，这一制度虽然从根本来说与合宪性审查仍然有着本质的差距，但是全国人大常委会备案审查制度的有效展开一方面能够为合宪性审查的推行提供良好的法律环境，另一方面也能过为合宪性审查制度的落实在一定程度上提供制度资源。在时机成熟后，备案审查制度也可以由合法性审查逐渐扩大到合宪性审查。对全国人大常委会备案审查制度予以充分的研究对于我国合宪性审查的推动具有积极的意义。另外，我国全国人大常委会2017年底公布了一批典型的备案审查案例。这一公布在我国备案审查历史上尚属首次。本文将对备案审查与合宪性审查相关概念进行厘清，明确备案审查制度与合宪性审查制度之间的关系，同时也对备案审查制度从性质上予以界定和明确；进而我国现行备案审查制度进行介绍，并对其发展的历史源流进行梳理，并结合这一批公布的备案审查典型案例选取其中较为重要和具有代表性的案例，逐一运用宪法学理论予以分析，最后通过对法律规范文本和经典案例的分析和对比，总结现行全国人大常委会备案审查制度存在的问题，并针对性的对备案审查制度的完善与发展提出解决对策。

备案审查制度在我国包含备案和审查两个部分，备案指制定规范性文件的机关在法定时间内将规范性文件报送法定机关进行备案；审查指就是接受备案的机关根据法定权限对备案的规范性文件的合宪性、合法性甚至适当性进行审查，并对违宪、违法等问题的文件予以变更或撤销。^[1]从我国目前的有关规定来看， 2015年最新修订的《中华人民共和国立法法》（以下简称《立法法》）第九十八条至第一百零二条对我国规范性文件的备案审查制度做出了专门规定。
