新媒体时代舆论对司法审判的不良影响及其规制

摘 要

二十一世纪是网络爆炸式发展的时代，传递信息的方式层出不穷，新媒体时代随之到来。由于新媒体的加持，各大网络平台凭借着传播广泛快速、影响巨大的自媒体优势，成为有别于传统媒体的新兴舆论阵地。舆论对司法审判的影响随着时间的推进变得越来越大，公民借助新媒体的优势所在有了更多自由言论的平台，这在一定程度上监督着司法审判的各个过程。但因诸多原因的出现，舆论与司法审矛盾突出的案件越来越多，如今新媒体时代形成的舆论对司法审判造成了不少消极影响，。

本文主要通过一些案件的分析，发现新媒体时代的舆论与司法审判之间的矛盾日益突出，舆论逐渐脱离了监督司法审判的积极影响，而转变成为“舆论审判”。司法机关在新媒体与民众的双重“监督”下，出现审判结果只得顺应民意的无奈现象。通过对这些现象的解读，得出新媒体时代下舆论现已存在干预司法独立、打击司法公正、削弱司法权威等消极影响，而产生这些消极影响的主要原因，包括司法公信力不足、新媒体监管的缺失以及公众主观意识的偏差。在此基础上，笔者提出了新媒体时代舆论对司法审判消极影响的规制，希望能实现司法和舆论良性互动。

The negative influence and regulation of publicopinion on judicial trial in the new media era

Abstract: Twenty-first Century is the era of explosive development of the Internet. The way of transmitting information is endless, and the era of new media is coming. With the development of new media, the large network platform has become a new position of public opinion which is different from the traditional media because of its wide spread and great influence on the self media. The influence of public opinion on judicial trial has become more and more great as time goes on. With the advantage of the new media, citizens have more free speech platforms, which, to a certain extent, supervises the process of judicial trial. However, because of many reasons, there are more and more cases of public opinion and judicial trial. Nowadays, the public opinion in the new media era has caused many negative effects on judicial trial.

In this paper, through the analysis of some cases, it is found that the contradiction between public opinion and judicial trial in the new media era is becoming more and more prominent, and the public opinion gradually deviated from the positive influence of the supervision of judicial trial, and it has changed into "public opinion trial". Under the dual supervision of the new media and the public, the judiciary has to face the helpless phenomenon of public opinion. Through the interpretation of these phenomena, it is concluded that public opinion has the negative influence on judicial independence, judicial justice and weakening of judicial authority in the new media era, and the main reasons for these negative effects are the lack of judicial credibility, the lack of new media supervision and the deviation of the public subjective consciousness. On this basis, the author puts forward the regulation of negative influence of public opinion on judicial trial in the new media era, hoping to achieve a positive interaction between judicature and public opinion.
