伴随着网络技术的飞速发展，网络世界里的虚拟财产在人们生活中的地位愈加重要，而对网络虚拟财产的侵犯案件也越来越多。该如何处理网络虚拟财产犯罪成为了一个难点。首先，网络虚拟财产虽为“财产”，但是关于其界定学界一直存在争议，本文将对学界的主要三种争议进行介绍和讨论，并在之后阐述笔者自己的观点。其次，是否要保护网络虚拟财产这个问题学界也是议论纷纷。本文将从国内外区域对网络虚拟财产的保护状况来进行了解，再结合网络虚拟财产的特点，对保护网络虚拟财产的正当性进行研究。最后一点，网络虚拟财产犯罪数额很难确定。本文将先对其原因进行探究。而确定网络虚拟财产犯罪数额，要明确网络虚拟财产的数额有哪些种类并对已有的犯罪数额确定标准进行了解。借鉴这些已有的标准，笔者提出自己的网络虚拟财产犯罪数额确定方法，按其行为性质将其划分，再按其财产性质的不同实行不同的价值评估方式。另外，在犯罪情节严重时，犯罪数额的确定又当是另一种情况。

Study on the determination of the crime amount of International virtual property

Abstract

With the rapid development of International technology, the International virtual property has played more and more important role in people's life. Also, the infringements of International virtual property have been more and more. How to deal with the crime of International virtual property has become a difficult point.

First of all, although the International virtual property is called "property", its definition has always been controversial in academic circles. This article will introduce and discuss the main three kinds of disputes in the academic circles, and then explain the author's own point of view. Secondly, whether to protect the International virtual property also has a lot of controversy in academic circles. This article will learn about the protection of the network virtual property from the domestic and foreign areas. Then combined with the characteristics of the network virtual property, I will study the legitimacy of protecting the network virtual property. Finally, the determination of the crime amount of International virtual property is very hard. This article will explore the reasons for this first. And to determine the crime amount of network virtual property, we need to clear the kinds of the amount of network virtual property and learn about the existing standards for determination of the crime amount. Referred with these existing standards, I will put forward my method of determination of the crime amount of International virtual property. It will divide actors’ behavior according to the nature, and then carry out different valuation methods according to the different nature of property. In addition, when the crime is serious, the determination of the crime amount is another situation.

网络虚拟财产犯罪数额确定研究

前言

随着网络技术的发展，互联网已经走入千家万户，人们在网络上的虚拟财产也越来越多，而因此受到的网络虚拟财产侵害也越来越多。在中国上海，一个名叫邱成伟男子在虚拟世界“热血传奇”中拥了一把屠龙刀。在这个游戏中，屠龙刀是最珍贵并且最难获得的一样装备。有一天，当他不在玩游戏的时候，他把他的屠龙刀借给一个信任的朋友简单地用一下，结果他的朋友却拒绝还屠龙刀并将其卖了获取现实货币。邱成伟激怒之下，杀死了他的朋友作为报复^[1]。邱成伟疯狂的举动让笔者震惊，同时也让笔者意识到网络虚拟财产在用户眼里是何等得重要，以及保护虚拟财产的必要性。

如何界定网络虚拟财产，国家是否需要保护网络虚拟财产，这些疑问在学界引起了广泛的争论。然而现实生活中不会因为存在争议就不发生网络虚拟财产的侵害案件，有侵害就应该有保护，笔者认为，网络虚拟财产是一种特殊的无形财产，虽然其性质学界出现了物、智力结果、债三种说法，但是从网络虚拟财产的取得方式来划分的话，可分成两类：一类是通过购买获得，一类是通过投入时间精力获得，那么网络虚拟财产的性质也可划分成两类：物、智力结果。很多国家和地区都对网络虚拟财产展开了保护，且保护网络虚拟财产确有其正当性，当务之急，网络虚拟财产的保护措施理当尽快到位，尤其是其犯罪额确定问题应当趁早解决。
