摘 要
改革开放后,物业在我国逐渐普及,它的出现促进了我国社区治理的发展,但同时也带来了许多新的问题。本篇文章结构上共分为四个章节。首先第一章分析我国物业与物业管理的现状;第二章阐述完善政府参与临时物业管理制度的必要性;第三章探讨政府委托临时物业行为的性质;第四章对政府委托临时物业的法律责任进行分析。
通过分析政府委托临时物业的性质,得出结论。政府在委托临时物业时应当签订委托协议,明确临时物业的资质、时效、费用以及法律责任。当临时物业出现侵害第三方权益的情况时,对外都由政府承担责任,对内的责任承担则要视情况而定。第一次委托时,若物业公司没有过错,政府承担六成责任,物业公司承担四成责任,若物业公司存在过错,则政府承担四成责任,物业公司承担六成责任;第二次委托时,若物业公司没有过错,政府承担百分之二十的责任,物业公司承担百分之八十的责任,若物业公司存在过错,由物业公司承担全部责任。

Analysis on Legal Liability of Government-entrusted Temporary Property
abstract
After the reform and opening of our country, the land is gradually spread, and its appearance has contributed to the development of our communities, but it has also led to many new problèmes.real estate management in china; on the other hand, there is the need to improve public participation in the temp orary real estate management system; on the other hand, there is the nature of the state entrusted to real estate behaviour; and on the other hand, there is the chapter analysing the legal responsibility of the government, whichdes property).
Through the analysis of the nature of the temporary property entrusted by the government, the conclusion is drawn. When entrusting temporary property, the government should sign an entrusting agreement to clarify the qualifications, limitations, costs and legal liabilities of temporary property. When the temporary property encroaches on the third party's rights and interests, the government is responsible for the external, while the internal responsibility depends on the situation. In the first commission, if the property company is not at fault, the government assumes majority responsibility, the property company assumes a small part of responsibility, if the property company is at fault, the government assumes minority responsibility, the property company assumes majority responsibility; in the second commission, if the property company is not at fault, the government assumes 20% responsibility, the property company assumes 80% responsibility, if the property company is at fault. The property company shall take full responsibility for the faults of the property company.
