摘 要

2001年《婚姻法》的颁布，无效婚姻制度得以正式地提出，婚姻法上的一大漏洞也得以填补。随后最高法院又陆续出台了一系列的司法解释，进一步地规范了无效婚姻纠纷中的财产处理等问题。现如今，人们的生活水平越来越好，这就导致近几年来，婚姻中的各方当事人越来越注重财产分割问题。而目前的法律规定，存在一定的滞后性，在面对层出不穷的新问题，无法及时解决无效婚姻纠纷中的财产处理问题，无法有效地解决司法实践中不同情形下的无效婚姻的财产处理问题。面对无效婚姻纠纷中的财产处理，立法上仍然存在着许多漏洞，需要立法者尽快完善立法，填补漏洞。

因此，本文主要厘清我国无效婚姻纠纷中的财产处理问题，具体讨论财产权利及债务在司法实践中如何处理，发现目前无效婚姻纠纷中财产处理存在的问题，进而研究完善无效婚姻纠纷中财产处理的相关立法，研究如何公平合理地解决财产处理问题，以达到平衡各方当事人利益的目标。

Analysis on the measures of Property Treatment in the Dispute of Invalid Marriage

Abstract

With the promulgation of the marriage law in 2001, the invalid marriage system was formally put forward and a major loophole in the marriage law was filled.Subsequently, the Supreme Court issued a series of judicial explanations one after another, further regulating the property treatment in invalid marriage disputes and other issues. Nowadays, people's living standard is getting better and better.This has led in recent years, the parties in the marriage attach increasing importance to the division of property.However, the current legal provisions have some hysteresis. Facing the emerging new problems, they cannot timely solve the property disposal problem in invalid marriage disputes and cannot effectively solve the property disposal problem in invalid marriage under different circumstances in judicial practice.In the face of the invalid marriage property in dispute processing, still there are many loopholes in the legislation, lawmakers need to perfect the legislation as soon as possible, fill the holes.
Therefore, this article mainly clarifies the problem of property disposal in invalid marriage disputes in China, specifically discusses how property rights and debts are handled in judicial practice, and finds out the existing problems in property disposal in invalid marriage disputes. Then study and improve the relevant legislation on property disposal in invalid marriage disputes, and study how to solve the property disposal problem fairly and reasonably，so as to achieve the goal of balancing the interests of all parties.

无效婚姻制度的设立，进一步地推动了婚姻家庭法律制度的完善。从2001年开始，经过十几年的发展，无效婚姻制度的规定越来越详细，涉及的范围越来越广。在2019年的现在，中国特色社会主义现代化建设进入了新的历史进程，小康社会的目标基本实现。在这样的时代背景下，家事审判出现了新的变化，人们的争议焦点越来越集中于财产权利及债务的分割问题。目前，在婚姻家庭法律制度中对于夫妻双方的财产处理问题，研究得已经比较详细，出台了一系列司法解释来解决这一方面的问题。但目前针对无效婚姻纠纷中的财产处理问题，法律和司法解释的规定相对而言比较少，不够全面，且不具有操作性。在司法实践中常常存在着一系列的问题，例如：忽略重婚中合法当事人的利益、忽视对于无过错方的保护等等。目前理论界、实务界难以攻克的一大难题便是如何公平合理地解决无效婚姻纠纷中的财产处理问题。因此，我们需要尽快完善无效婚姻纠纷中财产处理的相关立法。

1. 无效婚姻的概述

(一）无效婚姻的概念

我们首先要理解“婚姻”一词。婚姻是指男女双方自愿承诺永久生活在一起，这也是婚姻的目的。^[1]同时，一旦缔结婚姻，男女就享有夫妻间合法的权利义务。因此，婚姻指的是男女双方的结合形式，满足了结婚条件的法律规定，从而产生相应的法律效力。
